Terms of Use
1. Enrollment, Payment & Cancellation
Enrollment in the program is confirmed upon payment. You may cancel your membership at any time; however, all payments, including enrollment fees and any program fees, are non-refundable regardless of cancellation status. Payments cannot be transferred to another individual or applied to other treatments or services. All pricing is subject to change at any time without prior notice.
2. Eligibility Requirements
The SmileStay program is available only to patients who have completed orthodontic or dental treatment (including Phase I treatment) with a licensed provider. The Program must be paid in full to remain active. Participants must be 18 years of age or older, or have consent from a parent or legal guardian.
3. Nature of Services
Westside Orthodontic Lab, LLC is a dental laboratory that fabricates custom orthodontic retainers based on prescriptions, scans, or instructions provided by a licensed dentist or orthodontist. We do not provide dental diagnoses, orthodontic treatment, or treatment planning. All clinical decisions, treatment recommendations, and orthodontic supervision remain the responsibility of the patient’s licensed dental provider. Information provided on this website is for general informational purposes only and is not intended to replace professional dental or medical advice.
4. Retainer Replacement Policy
Retainers are custom-made medical devices and will be fabricated based on the current condition of your teeth at the time of replacement. Only one (1) set of retainers (upper and lower arch) will be produced at a time. Retainers are not eligible for returns or refunds, except as outlined under the Fit Guarantee.
5. Fit Guarantee
If a retainer does not fit properly upon initial delivery, you must notify Westside Orthodontic Lab, LLC within a reasonable timeframe for review and eligibility for a possible remake. Eligibility for the Fit Guarantee is determined by Westside Orthodontic Lab, LLC based on case review.
The Fit Guarantee does not apply if:
• Retainers were not worn as prescribed
• Significant time has passed since delivery or last use
• Tooth movement has occurred due to non-compliance
Westside Orthodontic Lab reserves the right to determine whether a remake is appropriate under this policy.
6. Wear Compliance & Fit Responsibility
Retainers must be worn exactly as prescribed by your treating dentist or orthodontist. Proper wear is required to maintain fit and prevent tooth movement. If a retainer is lost or damaged, you must contact Westside Orthodontic Lab, LLC within one (1) week to minimize the risk of shifting and ensure proper replacement. If retainers are not worn for more than one (1) week:
• Fit is not guaranteed
• Teeth may have shifted, which can affect replacement fit
• A new scan or dental appointment may be required at your provider’s discretion
• Additional fees may apply depending on the situation
If retainers have not been worn for 1–2 weeks or longer, Westside Orthodontic Lab, LLC is not responsible for fit issues resulting from tooth movement.
7. Limitations of the Program
The SmileStay program does not include orthodontic treatment, tooth movement, or correction of misalignment under any circumstances. This program is strictly limited to the fabrication and replacement of retainers based on the current position of the teeth at the time of scanning or replacement. Any changes in tooth alignment over time, whether due to non-compliance or natural movement, are outside the scope of this program. All orthodontic diagnosis and treatment decisions remain the responsibility of the patient’s licensed dentist or orthodontist.
8. Shipping & Delivery
Westside Orthodontic Lab, LLC is not responsible for delays caused by third-party shipping carriers. If retainers are shipped on time but delivered late, Westside Orthodontic Lab, LLC is not liable for any resulting dental issues or additional treatment needed.
9. Non-Transferability
This Program is non-transferable and may not be assigned or shared with another individual.
10. Limitation of Liability
To the fullest extent permitted by law, Westside Orthodontic Lab, LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to dental complications, additional treatment costs, pain, or loss of income. Westside Orthodontic Lab, LLC’s total liability, if any, shall not exceed the amount paid by you for the program.
11. Indemnification
You agree to indemnify and hold harmless Westside Orthodontic Lab, LLC from any claims, damages, or expenses resulting from:
• Failure to follow wear instructions
• Failure to seek timely dental care
• Misuse of retainers or services
12. No Guarantee of Outcomes
Westside Orthodontic Lab, LLC does not guarantee that retainers will prevent tooth movement or maintain alignment indefinitely. Outcomes depend on patient compliance and biological factors beyond our control.
13. Privacy
By enrolling in the program, you acknowledge and agree to our Privacy Policy regarding the collection and use of personal and dental information.
14. Modifications to Terms
Westside Orthodontic Lab, LLC reserves the right to update or modify these Terms of Use at any time. Continued participation in the program constitutes acceptance of any updates.
15. Governing Law
These Terms of Use shall be governed by and interpreted in accordance with the laws of the State of Indiana.
16. Legal Acknowledgment
By enrolling in the program, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must notify Westside Orthodontic Lab, LLC in writing within five (5) business days of enrollment. Failure to provide written notice within this timeframe constitutes full acceptance of these Terms.

24. Program Duration
The SmileStay program is offered for the operational lifetime of Westside Orthodontic Lab, LLC. In the event that Westside Orthodontic Lab, LLC ceases operations, the program will terminate, and no further services, replacements, or obligations will be provided.
25. Electronic Agreement and Consent
By using this website or enrolling in any program offered through it, you agree that such actions constitute your electronic signature and consent to be bound by these Terms of Use, with the same legal effect as a written agreement.
26. Entire Agreement & Severability
These Terms of Use, along with any referenced policies, constitute the entire agreement between you and Westside Orthodontic Lab, LLC regarding your use of this website and participation in the program. They supersede any prior or contemporaneous communications, whether written or verbal. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
